Terms of Use

Last updated: September 27, 2026

These Terms of Use (“Terms”) govern your use of NxtLvl Player (“the App”) on Apple TV, iPad, and iPhone. The App is developed and licensed by 9497-3658 Quebec Inc. (“we”, “us”), a company based in Quebec, Canada. By installing or using the App, you agree to these Terms.

1. What the App provides
NxtLvl Player is a client application that lets you browse and play media from sources you configure, including Xtream logins, M3U playlist links, and SMB shared folders on your network. The App provides the interface, playback tools, TV guide views, and optional iCloud sync for your settings.

2. Eligibility
The App is not directed at children. You may use the App only if you are old enough to form a binding contract where you live. If you are under the age of majority in your place of residence, a parent or guardian must accept these Terms on your behalf and remains responsible for your use of the App. The age rating shown on the App Store listing also applies. The App does not filter or restrict the content you supply to it, and it does not provide parental controls.

3. Your content and responsibilities
You are solely responsible for the playlists, credentials, files, and streams you add. You must have the legal right to access and play that content. The App developers do not supply channels, movies, or series, and do not monitor what you choose to watch.

You agree not to use the App to infringe copyright, violate applicable laws, or bypass access controls you are not authorized to bypass. You also agree not to use the App to harass, abuse, stalk, threaten, or defame any person or entity, and we are not responsible for any such use.

4. Third-party sources and availability
Streams come from servers and networks outside our control. Playback quality, availability, guide data, and metadata may change or stop working at any time without notice. We do not guarantee that any particular channel, title, or EPG entry will remain available. We may also change, suspend, remove, or impose limits on any external service the App connects to, at any time and without liability to you.

5. Third-party software and services
The App includes or connects to the components and services below. Your use of them is also subject to their own terms and licenses, which you agree to respect:
• VLCKit — the playback engine for most streams. Its core decoding behaviour is maintained by the VLC project, so we can only adopt the fixes its developers release.
• Apple AVFoundation — the alternative playback engine for supported streams.
• The Movie Database (TMDB) — posters, ratings, certifications, and Top Chart suggestions. This product uses the TMDB API but is not endorsed or certified by TMDB. TMDB may change its limits and availability at any time.
• OpenSubtitles — optional additional subtitles. OpenSubtitles caps how many subtitle requests can be made per day and may change its limits and restrictions at any time.
• YouTube — trailers open in the YouTube app or in a browser rather than inside our player, so that YouTube terms of service are respected. Playback there is governed by YouTube, not by us.
• Supabase — delivers the optional bug reports you choose to send.
• Apple iCloud and CloudKit — sync your playlists and settings.

We do not examine or evaluate the content or accuracy of these external services and are not liable for them. Some may be unavailable in your country or language.

6. Local network and shared folders
If you add an SMB source, the App connects to devices on your local network using the credentials you supply, and your device will ask for local network permission. You are responsible for the security of those devices, shares, and credentials. We do not relay, copy, or store your shared files on any server of ours.

7. iCloud sync
If you enable iCloud, your playlists and settings may sync across devices tied to your Apple ID using Apple’s CloudKit service. You are responsible for keeping your Apple account secure.

8. Support and feedback
Optional bug reports may include diagnostic information you choose to send. Do not submit sensitive credentials or unlawful material in feedback messages. We are solely responsible for providing any maintenance and support for the App; Apple has no obligation whatsoever to furnish maintenance or support services for it.

9. Subscriptions and purchases
Some features may require a paid subscription bought through Apple In-App Purchase.
• Payment is charged to your Apple ID account when you confirm the purchase.
• A subscription renews automatically for the same period and price unless you cancel at least 24 hours before the current period ends. Your account is charged for renewal within the 24 hours before the period ends.
• Where a free trial is offered, the trial converts to a paid subscription automatically unless you cancel before it ends, and any unused portion is forfeited if you purchase a subscription earlier.
• You can manage or cancel a subscription in your Apple ID account settings. Deleting the App does not cancel a subscription.
• Prices are set per storefront and may change. We will give notice of price changes as required by Apple and by law.

You pay Apple directly. We never receive or store your payment card details, and we cannot issue refunds — only Apple can, under its own policies. The App validates your purchase receipt with Apple. If Apple validation is unavailable, the App attempts a local check; if no valid receipt can be read, paid features may be temporarily unavailable until you restore purchases or sign out of and back into your App Store account.

We may in future introduce reasonable limits on the number of playlists, or on the number of devices signed in at the same time, per account.

10. Disclaimer of warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION.

11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 9497-3658 QUEBEC INC. AND ITS DEVELOPERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY CONTENT YOU ACCESS THROUGH IT.

12. Termination
These Terms apply until terminated. Your rights under them end automatically if you fail to comply with them, and we may suspend or end your access to features if you misuse the App. You may end these Terms at any time by deleting the App from your devices. Sections 3, 10, 11, 13, and 14 survive termination.

13. Governing law
These Terms are governed by the laws of the Province of Quebec and the applicable laws of Canada, without regard to conflict-of-law rules. If you are a consumer, you keep the benefit of any mandatory protections of the law where you live, including the Quebec Consumer Protection Act, and nothing in these Terms limits rights that cannot be limited by law.

14. Apple App Store terms
The following applies because the App is distributed through the Apple App Store.
• Acknowledgment: These Terms are concluded between you and 9497-3658 Quebec Inc. only, and not with Apple. We alone are responsible for the App and its content. These Terms do not set usage rules that conflict with the Apple Media Services Terms and Conditions.
• Scope of licence: We grant you a limited, non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing.
• Maintenance and support: We are solely responsible for maintenance and support. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
• Warranty: We are solely responsible for any product warranties, express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
• Product claims: We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation. These Terms do not limit our liability to you beyond what applicable law permits.
• Intellectual property: If a third party claims that the App, or your possession and use of it, infringes that party’s intellectual property rights, we are solely responsible for the investigation, defence, settlement, and discharge of that claim. This covers the App itself. You remain solely responsible for how you use the App and for the content you supply to it.
• Legal compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms: You agree to comply with applicable third-party terms when using the App, including those listed in section 5. In particular, you confirm that you have the right to watch the content you supply to the App, and that you are solely responsible for what you watch through it, the App being a player tool.
• Third-party beneficiary: You and we acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• Family Sharing: Family Sharing is a service operated by Apple and subject to Apple’s own terms, including limits on how often you may join or change a family group. We have no control over it beyond offering a subscription for which Family Sharing may be enabled.

15. Changes to these Terms
We may update these Terms when we release new App versions or features. Your continued use after changes become effective constitutes acceptance of the updated Terms.
